This site https://www.nhst.org.uk/ (our “site“) is brought to you by the National HIV Story Trust (“NHST“, “we” and “us“). Our aim is to film, record, preserve and share the history of those affected by the AIDS epidemic of the 80’s and 90’s.

We are a charitable organisation registered with the Charity Commission for England and Wales under number 1185923.  Our registered office is at Cameo House Business Centre, Cameo House, 11 Bear Street, London, WC2H 7AS.

By using our site, you confirm that you accept these terms of use (these Terms) and that you agree to comply with them. If you do not agree to these Terms, you must not use our site.

We may update and change our site, and amend these Terms, from time to time.  Every time you wish to use our site, please check these Terms to ensure you understand the terms that apply at that time.

Our site is made available free of charge.

Our aim is to keep this site up and running, but we do not guarantee that this site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for operational reasons. We will try to give you notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms, and that they comply with them.

Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

We do not restrict our liability for fraud, death or personal injury caused by our negligence, nor any other liability which we are not permitted to restrict or exclude as a matter of applicable law.

  1. Payment processing

Our site accepts donations to our charity via PayPal, Amazon Smile and easyfundraising (so we never have access to your card or bank information). These are third party services and they all have their own terms and conditions, so please make sure you have read them carefully.

We have no responsibility or liability for any act or omission of third party payment processors, or for their terms of service or privacy policies.

You warrant that you have all necessary authorities to use the payment cards whose details you provide.

  1. Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

  1. Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

These Terms and the relationship between you and us shall be governed by the laws of England without regard to any conflict of law provisions of any jurisdiction. You and we agree to submit to the exclusive jurisdiction of the English courts, except that NHST may seek injunctive relief in any jurisdiction in order to enforce our rights under these Terms.

No person other than you shall have any rights under these Terms, save that our third party licensors may take action against you to enforce their intellectual property rights or other rights.

NHST’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, you and we agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

You agree that these Terms represent the entire understanding between you and NHST in relation to this site and our Content. These Terms supersede any previous agreements between you and us including any previous version of these Terms.
